These Terms of Service, in conjunction with our Privacy Policy, govern your use of all services and apps provided by Controlla-TV (hereinafter referred to as "Controlla-TV"). It is imperative that you carefully read and understand these terms prior to utilizing Controlla-TV. By utilizing Controlla-TV, you hereby agree to be bound by the terms outlined in these Terms of Service. If you do not agree to these terms, you are prohibited from using Controlla-TV. If you are accessing Controlla-TV on behalf of an organization, such as your employer, you are indicating that you have the authority to bind said organization to these terms, and in such case, "you" and "your" shall refer to said organization.

Controlla-TV reserves the right to revise these terms at any time, and any changes will be reflected within our apps. It is your responsibility to regularly check for updates to these terms.

 

Auto Renewing Subscriptions and Subscription Services on Controlla-TV

The utilization of certain apps provided by Controlla-TV on the Google Play Store may be made available through subscription services. Such subscriptions, which may include options for daily, weekly, monthly or yearly payment, may be processed through the app, by third parties acting on our behalf, or directly by the mobile platform owner (such as Google). Payment for subscriptions may be automatically renewed, however, you may cancel the subscription service at any time during the subscription period without being charged via the subscription settings within your Google account. The cancellation will take effect at the conclusion of the current subscription period. For more information regarding canceling orders and any associated refunds, please consult the website of the third-party reseller from whom the app was purchased (Google Play Store).

 

From time to time, certain subscription services provided by Controlla-TV on the Google Play Store may be offered on a free-trial basis for a fixed period of time. You are entitled to cancel a free-trial subscription at any time through the subscription settings within your Android account.

 

Your Responsibilities on Controlla-TV Apps

You may use Controlla-TV only if you are 13 years or older and are not prohibited from using the app under applicable law.

 

Controlla-TV Intellectual Property Rights

Controlla-TV and its licensors retain exclusive ownership of the Controlla-TV app, including all associated intellectual property rights. It is acknowledged that the Controlla-TV is protected by copyright, trademark, and other laws of foreign countries. The user agrees not to remove, alter, or obscure any copyright, trademark, service mark, or other proprietary rights or notices incorporated in or accompanying the Controlla-TV.

Controlla-TV grants the user a limited, non-exclusive, non-transferable license to view, copy, and display the Controlla-TV app solely for the purpose of the user's permitted use of the app.

 

General Prohibitions on Controlla-TV

You hereby agree not to undertake or attempt to undertake any of the following actions:

• Probe, scan, or test the vulnerability of any Controlla-TV system or network or breach any security or authentication measures;

• Access, tamper with, or utilize non-public areas of the Controlla-TV app, the computer systems of Controlla-TV, or the technical delivery systems of Controlla-TV's providers;

• Decipher, decompile, disassemble, or reverse engineer any software used in the provision of the Controlla-TV app;

• Interfere with, or attempt to interfere with, the access of any user, host, or network, including but not limited to, sending a virus, overloading, flooding, spamming, or mail-bombing Controlla-TV;

• Access or search the Controlla-TV app or download any intellectual property from the Controlla-TV app through the use of any engine, software, tool, agent, device, or mechanism (including but not limited to spiders, robots, crawlers, data mining tools, or the like) other than the publicly supported interfaces provided by Controlla-TV;

• Plant malware or use the Controlla-TV app to distribute malware;

• Send any unsolicited communications, promotions, advertisements, or spam;

• Send altered, deceptive, or false source-identifying information, including "spoofing" or "phishing";

• Post or transmit anything that is fraudulent or misleading, or that infringes on others' rights;

• Impersonate or misrepresent your affiliation with any person or entity;

• Violate any applicable law or regulation; or

• Encourage or enable any other individual to do any of the above.

DMCA/Copyright Policy

In compliance with copyright laws, it is the policy of Controlla-TV to terminate the accounts of those who repeatedly infringe, or are believed to repeatedly infringe, the rights of copyright holders. If you believe that a product offered by Controlla-TV infringes on your copyright, please direct your complaint to the designated copyright agent of Controlla-TV at support@controlla-tv.com in accordance with the Digital Millennium Copyright Act (DMCA)

 

 

Termination on Controlla-TV

This License is effective until terminated. Your rights under this License will terminate automatically without notice from Controlla-TV if you fail to comply with any terms of this License. You may terminate this License at any time. Upon termination of this License, you shall cease all use of the Software and destroy all its copies and parts.

 

Warranty Disclaimers

Controlla-TV or our licensors' intellectual property are provided "as is," without warranty of any kind. Without limiting the foregoing, we explicitly disclaim any implied warranties of merchantability, fitness for a particular purpose, quiet enjoyment, and non-infringement and any warranties arising out of course of dealing or usage of trade. We make no warranty that Controlla-TV will meet your requirements or be available on an uninterrupted, secure, or error-free basis. We make no warranty regarding the quality, accuracy, timeliness, truthfulness, completeness, or reliability of any of our intellectual property."

 

Indemnity on Controlla-TV

You will indemnify and hold harmless Controlla-TV and its officers, directors, employees and agents, from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (i) your access to or use of Controlla-TV or our licensors' intellectual property; (ii) your content; or (iii) your violation of these terms.

 

Limitation of Liability on Controlla-TV

Neither Controlla-TV nor any other party involved in creating, producing, or delivering Controlla-TV, including our licensors, will be liable for any incidental, special, exemplary or consequential damages, including lost profits, loss of data or goodwill, service interruption, computer damage or system failure or the cost of substitute services arising out of or in connection with these terms or from the use of or inability to use Controlla-TV or our licensors' intellectual property, whether based on warranty, contract, tort (including negligence), product liability or any other legal theory, and whether or not Controlla-TV has been informed of the possibility of such damage, even if a limited remedy set forth herein is found to have failed of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

In no event will Controlla-TV's total liability arising out of or in connection with these terms or from the use of or inability to use Controlla-TV or to access your content exceed the amounts you have paid to Controlla-TV for use of Controlla-TV, if you have not had any payment obligations to Controlla-TV, as applicable. The limitations of damages set forth above are fundamental elements of the basis of the bargain between Controlla-TV and you."

 

Governing Law

These terms will be governed by the laws of Singapore and Vietnam, without regard to its conflict of laws provisions.

General Terms

These terms and conditions constitute the entire and exclusive agreement between Controlla-TV and the user regarding the use of Controlla-TV and supersede any prior agreements or understandings, whether written or oral. If any provision of these terms is determined to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be enforced to the maximum extent possible and the remaining provisions shall remain in full force and effect.

Without the prior written consent of Controlla-TV, the user may not transfer or assign these terms. Controlla-TV, however, may freely assign or transfer these terms without restriction. These terms shall be binding and inure to the benefit of the parties, their successors and assigns.

Any notices or communications from Controlla-TV under these terms, including but not limited to those regarding modifications to these terms, shall be given through email or by posting on our website. The failure of Controlla-TV to enforce any right or provision under these terms shall not be deemed as a waiver of such rights.
